Terms of Use

1. Agreement

These Terms govern your access to the Adverta Tools website and Windows application (together, the “Service”). By creating an account, downloading, installing or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

You must have legal capacity to enter into this agreement. If local law requires consent from a parent or guardian, you may use the Service only with that consent.

2. The Service

Adverta Tools provides utilities for image slicing, metadata editing, batch watermarking, palette extraction and screen color picking. Features, supported formats and system requirements may change as the product develops.

We may release fixes, security updates and new versions. Some updates may be required to keep the Service secure or compatible with Windows.

3. Account and security

You must provide accurate information and keep your sign-in details secure. You are responsible for activity performed through your account. Tell us through the support channel in the Service if you believe your account has been accessed without permission.

One person may not create accounts to repeatedly obtain introductory trial periods or bypass plan limits.

4. Trial, plans and renewal

The standard Free Trial lasts 14 days unless an offer states otherwise. Trial availability may be limited to one trial per user or device. After the trial, continued access requires a paid plan.

Monthly and Annual plans are billed for the period shown at checkout. Before any payment, you will see the final price, currency, taxes where applicable and renewal terms. If recurring billing is enabled, the plan renews until cancelled. Cancellation stops future renewal and does not remove access already paid for through the end of the billing period, except where law requires otherwise.

Promo codes may have their own eligibility, expiry and usage limits. They cannot be exchanged for cash or combined unless the offer says so.

5. Licence and permitted use

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the application for lawful personal or business work during your trial or active plan.

You may not:

  • copy, resell, sublicense or distribute the application except as expressly allowed;
  • reverse engineer or bypass technical restrictions, except where applicable law expressly permits it;
  • use the Service to violate another person’s rights, process unlawful content or distribute malware;
  • interfere with the Service, its security or other users;
  • use automated means to abuse registration, trials, promotions or access controls.

6. Your files and output

You keep ownership of the files you open and the output you create. You confirm that you have the rights needed to process those files. Core editing operations are designed to run locally on your device.

You are responsible for checking previews and exported files and for keeping backups. Do not use the Service as the only copy of important material.

7. Intellectual property

The Service, brand, interface, software and documentation belong to Adverta Tools or its licensors and are protected by intellectual property laws. These Terms do not transfer ownership of the Service to you.

8. Availability and third-party services

We aim to keep the Service available, but uninterrupted operation cannot be guaranteed. Account, payment, hosting or update functions may rely on third-party providers whose own terms may also apply.

We may suspend access when reasonably necessary for security, maintenance, suspected abuse or legal compliance.

9. Disclaimer and liability

The Service is provided on an “as available” basis. To the fullest extent permitted by law, we do not guarantee that every file, format, device or workflow will work without interruption or error.

To the fullest extent permitted by law, Adverta Tools is not liable for indirect, incidental or consequential loss, lost profits or lost data. Our total liability relating to the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

10. Termination

You may stop using the Service at any time. We may restrict or end access if you materially breach these Terms, misuse the Service or create a security or legal risk. Where reasonable, we will give notice and an opportunity to correct the issue.

11. Changes and applicable law

We may update these Terms when the Service, business model or legal requirements change. Material changes will be communicated through the website, application or account before they take effect where required.

These Terms are governed by the law applicable to the Service provider, while mandatory consumer protections in your country remain unaffected. Questions or disputes should first be sent to write.adv3rta@gmail.com.
